Terms & Conditions

Please read the terms and conditions in full before agreeing to work with me.

 

YOUR BRIEF - Please include deadlines, relevant information, and word count.

 

YOUR QUOTATION - Your quotation includes all consultation and advice and up to two rounds of complimentary revisions.

It does not include work outside of the original brief, revisions after the final draft.

 

CONFIRMATION – We require confirmation in writing, this is fine by e-mail.   Your confirmation ensures that:

You are authorised to commission the work either directly or on the behalf of a third-party client.

You have read and understood the terms and conditions.

You agree to the most recent quoted amount.

You are happy for me to commence the works outlined in the quote and brief.

 

MEETINGS – Please note that, unless specified otherwise, all meetings will take place via Zoom.  Please note that any meetings required in person once confirmed will count as billable hours. 

 

TIMESCALE – Every effort will be made to meet your deadlines but, on incredibly rare occasions, I may not be able to do so due to reasons outside of my control.   Under such circumstances, I am not liable for any loss or damages to you or your client.

 

RIGHTS AND PERMISSIONS – Where images are required, I will provide copyright-free images from Pixaby.  However, I cannot accept liability for ensuring that the necessary rights and permissions to use my work have been granted.  This is in relations to the use of names, people, trademarks, registered or copyright words of phrases.

 

COPYRIGHT – You must confirm that you own the copyright for any written materials that you supply to be included or adapted for use, within your project.

 

OWNERSHIP – Until payment is made in full, I retain the copyright of any materials.   Unless expressly prohibited, I retain the right to use excerpts of your project on my website and within my portfolio. www.crgoddard.com.  I will only use your logo with your express permission.

 

PAYMENT – Payment is due within14 days of invoice.  Please note that I only accept payment via BACS.

 

LATE PAYMENT – If your payment is late, I reserve the right to charge a late payment charge in line with The Late Payment of Commercial Debts (Interest) Act 1998.

CANCELLATION OR MISCOMMUNICATION  - If you decide to cancel your project after you have commissioned it in writing, I reserve the right to charge for the hours I have worked on the project, up to the point of being informed of the cancellation.

If you decide to cancel your project after delivery of the first draft, you will be liable for the total fee, as specified in your written quotation.

If you are sent a draft of the project and fail to respond to this or any further communications from me over a prolonged period, you will be liable for the total fee, as specified in your written quotation.

These conditions apply whether or not you intend to make use of the materials I have supplied.

INDEMNITY CLAUSE - I make every effort to ensure that your project is completed on time and to an exceptional standard.  However, in the unlikely event that something may go wrong, I have to include an indemnity clause. You agree to indemnify me against:

Any claim for compensation, loss compensation or damages resulting from your use, inability to use or reluctance to use the materials I have supplied;

Any claim by a third-part client for compensation, loss compensation or damages resulting from the use, inability to use or reluctance to use the materials I have supplied;

Any claim for loss, compensation or damages arising because the necessary rights, permissions and releases have not been granted;

Any claim over breach of copyright relating to materials you have supplied to me; and

Any claim over factual or statistical inaccuracies in materials you have supplied to me.

IF YOU AREN’T HAPPY – My aim throughout our project will be to deliver work that you love and feel proud of.  If, at any point, you feel something isn’t going the way you like, please tell me and I will aim to rectify it immediately.
